Terms of Use

By accessing or using Stilume (the "Service"), you agree to be bound by these Terms of Use (the "Terms"). If you do not agree to these Terms, you may not access or use the Service.

Stilume is operated by Aleksandr Korzin, an individual entrepreneur registered in the Republic of Armenia (“Stilume,” “we,” “our,” or “us”). We may update these Terms from time to time. If we make changes, the updated Terms will become effective when posted, unless otherwise stated.

You may use the Service only if:

• •you are legally capable of entering into a binding agreement;
• •you comply with these Terms and all applicable laws and regulations; and
• •you provide accurate, current, and complete account and billing information.

If you use the Service on behalf of a company or other organization, you represent and warrant that you have authority to bind that entity to these Terms.

Stilume is a product visual design platform for ecommerce brands, agencies, and creative teams. The Service includes AI-assisted tools that help users create and edit commercial product imagery.

Users may, among other things:

• •create projects;
• •upload product images and other content;
• •build scenes in a visual editor by placing product images and other objects;
• •configure scenes, objects, and styles;
• •generate final images with AI-assisted tools;
• •download generated images; and
• •store, manage, and delete projects and generated images within the Service.

The Service relies in part on third-party generative AI models and related service providers. AI-generated output may contain errors, inconsistencies, or other limitations. You are solely responsible for reviewing any output before using, publishing, sharing, or relying on it.

We may change, improve, suspend, or discontinue any part of the Service at any time, with or without notice.

You are responsible for:

• •maintaining the security and confidentiality of your account credentials;
• •all activity that occurs under your account;
• •keeping your login, billing, and profile information accurate and up to date; and
• •promptly notifying us if you believe your account has been accessed or used without authorization.

We may suspend or terminate access to your account if we reasonably believe that your account is being used in violation of these Terms, applicable law, or in a manner that creates risk, harm, or liability for the Service, our users, or third parties.

Some features of the Service may require a paid subscription or other paid purchase. If you purchase a paid plan or other paid feature:

• •you agree to pay all applicable fees, taxes, and charges;
• •your subscription may renew automatically unless you cancel before the renewal date;
• •you authorize us and our payment processors to charge your payment method for each renewal term unless you cancel;
• •plan features, usage limits, and pricing may change prospectively; and
• •failure to pay may result in suspension, downgrade, or loss of access to paid features.

You may cancel your subscription through the billing tools made available in the Service. If you cancel, your subscription will not renew for a subsequent billing period, and your paid access will continue until the end of your current billing period unless otherwise required by law.

Except where required by applicable law, all fees are non-refundable. Because AI image generation and related processing create immediate costs when the Service is used, we do not provide refunds for subscriptions, credits, usage-based charges, or other purchases made through the Service.

You may upload images, text, prompts, project data, and other materials to the Service ("User Content"). You retain your rights in your User Content.

You grant Stilume a limited, non-exclusive, worldwide, revocable license to host, store, reproduce, process, transmit, display, and use your User Content solely as necessary to:

• •operate and provide the Service;
• •provide requested features and functionality;
• •generate outputs;
• •store and display your projects and results;
• •maintain security and prevent abuse;
• •provide customer support; and
• •improve the reliability and operation of the Service.

You represent and warrant that:

• •you own or have all necessary rights, licenses, consents, and permissions to upload, use, and submit your User Content;
• •your User Content does not infringe, misappropriate, or otherwise violate any third-party rights, including intellectual property, privacy, publicity, or contractual rights; and
• •your User Content does not violate any applicable law or these Terms.

The Service may generate images or other output based on your inputs ("Output").

As between you and Stilume, and subject to any rights in your User Content and any applicable third-party rights, you retain any rights you may have in Output generated through the Service and may use that Output for lawful purposes.

We do not guarantee that any Output:

• •is accurate;
• •is complete;
• •is unique;
• •is non-infringing;
• •is commercially usable;
• •is legally compliant; or
• •is suitable for your specific purpose.

You are solely responsible for reviewing Output and determining whether it is appropriate for your intended use.

You may use the Service only for lawful purposes and in compliance with these Terms. You may not use the Service to:

• •violate any law, regulation, or third-party right;
• •upload or use content that you do not have the right to use;
• •infringe intellectual property, privacy, publicity, or other rights;
• •create, generate, publish, or distribute deceptive, fraudulent, defamatory, abusive, unlawful, or harmful content;
• •create misleading product representations, false advertising materials, impersonation content, or content that misrepresents affiliation, endorsement, origin, or commercial characteristics of a product or brand;
• •create exploitative, harmful, or illegal material;
• •reverse engineer, disrupt, overload, or interfere with the Service;
• •scrape, probe, or access non-public areas of the Service;
• •bypass usage limits, account restrictions, or security controls; or
• •use the Service in a way that creates risk, liability, or harm for Stilume, other users, or third parties.

We may investigate suspected violations of these Terms and take appropriate action, including removing content, limiting features, suspending accounts, terminating access, or reporting conduct where required by law.

The Service may rely on or integrate with third-party providers, including providers of hosting, authentication, storage, payment processing, analytics, and generative AI services.

To provide the Service, we may transmit or make available User Content and related data to such third-party providers solely as necessary to operate the Service and deliver requested functionality.

We do not use your User Content or Output to train our own AI models.

Third-party providers may process your data and content in accordance with their own terms, policies, and legal obligations. We are not responsible for the availability, accuracy, security, or practices of third-party services.

We do not guarantee that the Service will be uninterrupted, secure, or error-free. The Service may be unavailable from time to time due to maintenance, upgrades, outages, third-party failures, or events beyond our reasonable control.

We may update these Terms from time to time. Updated Terms become effective when posted, unless otherwise stated. Your continued use of the Service after the effective date of updated Terms means that you accept them.

You may stop using the Service at any time.

We may suspend or terminate your access to the Service, with or without notice, if:

• •you breach these Terms;
• •we are required to do so by law;
• •your use creates risk, harm, or liability;
• •we discontinue the Service; or
• •we reasonably determine that suspension or termination is necessary to protect the Service, our users, third parties, or our legal and business interests.

Upon termination, your right to use the Service will end immediately. Provisions that by their nature should survive termination will survive, including those relating to ownership, payment obligations, disclaimers, limitations of liability, and dispute resolution.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:

• •THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE;
• •THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; OR
• •ANY OUTPUT WILL BE ACCURATE, RELIABLE, NON-INFRINGING, LEGALLY COMPLIANT, OR SUITABLE FOR YOUR NEEDS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STILUME AND ITS OPERATOR, AFFILIATES, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

• •THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
• •USD $50.

These Terms are governed by the laws of Armenia, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Armenia, unless applicable law requires otherwise.
